GENERAL TERMS AND CONDITIONS (GTC)
1. Scope of Application
1.1 These General Terms and Conditions (“GTC”) apply to the music streaming service “audiorooms” offered by Audiorooms GmbH (hereinafter referred to as “Audiorooms”) on its website, which users can access via www.audiorooms.de.
1.2 By using the website, and at the latest upon personal registration, the user accepts the validity of these GTC.
1.3 In addition to these GTC, the Privacy Policy applies, which can be accessed at any time on www.audiorooms.de.
2. Subject of the Contract
2.1 Audiorooms provides background music for business customers via an online streaming service. The music catalogue is free of any fees payable to collecting societies.
2.2 The main service of Audiorooms consists of providing music files that the user can play via an online player. Downloading the music files is excluded and prohibited. Music is provided exclusively via streaming unless other forms of playback have been agreed.
2.3 The subscription includes usage rights to music tracks. Pricing depends on room size and number of rooms. Upon subscribing, the user gains access to tracks and playlists. All music on www.audiorooms.de is royalty-free and not represented by collecting societies.
2.4 Confirmation of Royalty-Free Status and Music Source
Audiorooms provides more than 16,000 tracks via its platform as a reseller. Rights holder and administrator is:

During the subscription period, the user receives a certificate confirming that the music can be used without fees payable to collecting societies such as PRS FOR MUSIC and further collecting societies like GEMA, AKM or SUISA.
3. Scope of Services
3.1 Audiorooms offers over 16,000 royalty-free music tracks. A 7-day free trial is provided and does not renew automatically. After expiry, the account is suspended unless a paid subscription is purchased.
3.2 “Subscribers” are users with paid accounts.
3.3 Music may only be used as background music in business premises such as hotels, restaurants, shops, studios, offices, or events. It may not be integrated into videos or sold, copied, or shared. Violations incur a minimum penalty of €1,000.
3.4 Each account may be used at only one location.
3.5 The user is responsible for technical requirements and internet connectivity.
4. Registration
4.1 Registration requires an email address, password, acceptance of GTC and privacy policy, and payment details.
4.2 Audiorooms may reject registrations without reason.
4.3 By registering, the user agrees to receive service-related emails.
5. User Account
5.1 Each user receives a personal account (“My Account”).
5.2 Users may manage data and playlists.
5.3 Sharing login details is prohibited.
5.4 Streaming is permitted on one device at a time.
6. Subscription
6.1 Paid access is only available to subscribers.
6.2 Contract is concluded when Audiorooms confirms the subscription via email.
7. Prices, Payment & Invoicing
7.1 Prices are net and subject to VAT. Audiorooms may change prices with notice.
7.2 Payment methods include invoice and SEPA direct debit.
7.3 Invoices are issued according to the selected billing cycle.
7.4 Late payments may result in account suspension.
7.5 German law applies. Jurisdiction is Kassel, Germany.
8. Contract Term and Termination
8.1 Trial users may cancel at any time.
8.2 Paid subscriptions run for 3, 6 or 12 months and renew automatically unless cancelled 4 weeks before expiry.

8.4 Audiorooms may terminate without notice in case of violations.
9. Right of Withdrawal
Under §356(5) BGB, the right of withdrawal expires for digital content such as streaming once usage begins. By signing up, the user agrees to waive the right of withdrawal.
